General Terms and Conditions (AGB) of Adept GmbH

I. General Provisions

1. Applicability; User Eligibility; Language

1. These general terms and conditions ("Terms") apply to all services offered by Adept GmbH, Borsigstraße 27, 10115 Berlin, Germany, registered with the Charlottenburg District Court under HRB 265477B ("Adept", "we", or "us") through our website and any associated online services ("Platform").
2. Our services are exclusively intended for consumers within the meaning of § 13 of the German Civil Code (BGB). "Consumers" are natural persons who enter into a legal transaction for purposes that are not predominantly commercial or self-employed.
3. The contract language is English.

2. Warranty Rights; Liability

1. The statutory warranty provisions apply.
2. Claims for damages are excluded except for damages resulting from injury to life, body, or health, or from intentional or grossly negligent breaches of essential contractual obligations.
3. We do not guarantee uninterrupted or error-free availability of the Platform and are not liable for technical malfunctions.

3. Governing Law; Jurisdiction; Severability

1. These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Sales Convention. Mandatory consumer protections from your country of residence remain unaffected.
2. Jurisdiction for all disputes is Berlin.
3. If any provision of these Terms is or becomes invalid, the remainder of the Terms shall remain unaffected.

II. Service Terms

1. Services Offered

1. Adept provides professional hair salon services. Appointments can be booked online. Gift cards may be purchased via our Platform.
2. Services are provided at our salon location. There is no shipment of physical products.

2. Booking and Cancellation

1. Appointments can be scheduled via our online booking system.
2. Cancellations and rescheduling must be made at least 24 hours in advance. Failure to cancel within this period or no-shows will incur a 100% service fee.

3. Payment

1. Payments may be made via card or cash, either on-site or online (if available).
2. All prices include applicable VAT.
3. Services are non-refundable, including missed appointments or late cancellations.

4. Gift Cards

1. Gift cards can be purchased online or in-store and used for services provided by Adept.
2. Gift cards are non-refundable, cannot be exchanged for cash, and are not transferable.
3. If no expiration date is stated, gift cards are valid for 3 years from the purchase date.

5. Use of the Platform

1. Users are granted a limited, non-transferable right to use our Platform.
2. Any misuse, including automated data extraction, is prohibited.

6. System Availability
We strive to provide constant availability of our Platform but cannot guarantee uninterrupted access due to maintenance, updates, or unforeseen technical issues.

7. Termination
Users may stop using the Platform at any time. We reserve the right to deny access for cause.
